TYPES OF WORKPLACE INVESTIGATIONS
We conduct workplace investigations into complaints of harassment/hostile work environment, discrimination and retaliation; allegations of a toxic work environment/abusive conduct and bullying; and allegations of misconduct/violation of employer policy.

Investigations in the public sector – we have spent the past 20 years conducting workplace investigations in the public sector, and understand the unique due process requirements applicable to public sector employers, particularly those involving law enforcement and other safety personnel.

Investigations in the private sector – we have significant experience conducting investigations involving high-level employees, including board members, corporate executives and management-level employees.
PROCESS BREAKDOWN FROM INITIATION TO CONCLUSION

An investigation is initiated when an employer retains Kramer Workplace Investigations. Typically, we interview the complainant (when there is one) first. Upon obtaining the details surrounding the complaint and the specific incidents of alleged misconduct, the attorney investigator and the employer debrief to ensure both are on the same page regarding the scope of the investigation;

Once the employer confirms the scope of the investigation, we conduct witness interviews, review relevant documents and physical evidence, and identify possible issues that may not have been previously raised or identified, all while maintaining communication with the employer to provide updates regarding the progress of the investigation;

We assess the credibility of witnesses when pertinent facts are disputed, and prepare comprehensive reports, or reports with the level of detail requested by the employer (full report summarizing all witness interviews; summary report; executive summary; or oral report);

Kramer Workplace Investigations’ goal is to ensure that all participants understand the process, and feel heard and treated with respect; and

Finally, Kramer Workplace Investigations works to “right-size” the investigation to ensure it is commensurate with the issues being investigated and to stay within the budget determined by the employer.
POST-INVESTIGATION EXPERIENCE
Kramer Workplace Investigations’ attorney investigators have significant experience testifying post-investigation. We have testified on over 20 occasions in depositions, arbitrations, and Commission hearings. We also have experience participating in post-investigation discussions with governing bodies to ensure they understand our methodology and why the findings we made were appropriate.
